Introduction and Governing Law
These are the Terms and Conditions of Sale applicable to purchases from The Colour Cartel. The use of this site is governed by the policies, terms and conditions set forth below. Please read them carefully. Your use of this site indicates your acceptance of these terms and conditions.
These terms and the State and Federal laws of Victoria, Australia and The Commonwealth of Australia apply to all transactions for the purchase of products and services from The Colour Cartel, its web site at www.thecolourcartel.com.au and any associated web page (the "Site"). These terms represent the complete Agreement between The Colour Cartel and the Buyer covering the sale of Products and Services from this Site.
Except for terms implied by applicable legislation, The Colour Cartel does not offer or agree to any conditions, warranties, guarantees or representations relating to the quality, description or performance characteristics of the Products other than those set out in these terms.
The Buyer's completion of the order form on this Site will constitute an offer to the Buyer to purchase Products (the "Order"). All Orders are subject to acceptance by The Colour Cartel. Your receipt of an electronic or other form of Order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. The Colour Cartel reserves the right at any time after receipt of your order to accept or decline your order for any reason.
Liability
The Colour Cartel is not liable for any losses or damages caused by this website or any website linked to or from this website.
Prices
The prices to be paid by the Buyer for all Products will be The Colour Cartel's current selling price on the date of receipt by The Colour Cartel of the Order, less any applicable discounts in effect at that time. All Orders will attract a delivery charge.
The Colour Cartel will not be responsible for errors in pricing that appear on the Site. The Colour Cartel will notify a Buyer in the event of a pricing error on the Site before an Order is delivered and the Buyer will have the opportunity to cancel its Order within a reasonable time. The Colour Cartel reserves the right to cancel unilaterally any Order based on a mistake in pricing within a reasonable time of receiving that Order.
The Colour Cartel reserves the right to change its prices from time to time without prior notice to the Buyer. All orders from The Colour Cartel PTY LTD include Australian Goods and Services Tax (GST).
"List price" is an estimate of the standard full price of the product, based on a standard industry mark-up. Products may never have actually been sold by The Colour Cartel at the "list price".
Stock Availability
If a Product is out of stock when The Colour Cartel processes an Order, The Colour Cartel will contact the Buyer to discuss alternative available or refund options as well as revised delivery times.
Order Delivery
All Orders by the Buyer under this Agreement must be placed via the forms provided on this Site and must specify the information requested, including (but without limitation):
(a) Quantity and description of Products
(b) The full street address to which the Product is to be delivered
(c) Current billing address to which credit card statements are sent.
The Buyer must complete all information requested on the Order form before the Order is processed by The Colour Cartel.
The Colour Cartel will send the Buyer an e-mail acknowledging the Products ordered as soon as possible after the Buyer places an Order. If The Colour Cartel does not accept the Buyer's Order for any reason, it will inform the Buyer by email in the same manner.
Delivery times quoted in the Site are indicative only. The Colour Cartel will endeavour to deliver your order within the specified time. The Buyer acknowledges that The Colour Cartel may, from time to time, be subject to production, delivery or other unforeseen delays and that The Colour Cartel may allocate distribution of Products ordered among its customers at its sole discretion.
If Buyer's Order has not been delivered within the stated time, the Buyer should contact The Colour Cartel at: hello@thecolourcartel.com.au
If no-one is available at the delivery address to receive the Products, The Colour Cartel's delivery agent will leave an "unable to deliver" card at the address and the Buyer should follow the directions on that card to obtain delivery of the Products. The Colour Cartel reserves the right to make partial delivery of an Order where multiple products have been ordered.
Payment
Credit card payment for Products purchased from The Colour Cartel via the Site can be made by VISA, MasterCard or American Express credit cards.
The Colour Cartel will verify the credit card information submitted by the Buyer and will advise the Buyer that its Order has been accepted. The Buyer agrees to submit to The Colour Cartel such information as may be reasonably requested by The Colour Cartel for the authorisation and verification of its credit card purchases.
The Colour Cartel reserves the right to conduct payment verification tests to ensure legitimate use and ownership of a credit card by the Buyer. This includes processing an additional nominal charge to a Buyer's credit card that subsequently be refunded.
The Colour Cartel reserves the right to exercise its lawful remedies if a dispute arises over payment through the Buyer's credit card provider. In particular, but without limitation, if the Buyer's credit card provider rejects a payment when due, The Colour Cartel at its discretion may delay or cancel delivery of Orders placed by the Buyer.
The Colour Cartel may also offset and deduct from any refund due to the Buyer all sums owed by the Buyer to The Colour Cartel. If the Buyer's account is placed in collection, The Colour Cartel will be entitled to claim all reasonable expenses for collection, including legal fees incurred in connection therewith.
Payment by Direct Bank Deposit must be confirmed in The Colour Cartel's bank account before goods will be shipped.
Discount codes
One discount code per order. Multiple codes cannot be used in conjunction on an order.
Product Returns
Due to the nature of the product being produced by The Colour Cartel, once an order is placed The Colour Cartel cannot offer any type of exchange or refund, except in warrantable circumstances. The Colour Cartel will not provide refunds for product returns other than in circumstances where required by Australian State and Federal Law.
The Buyer is responsible for return shipping arrangements and for all shipping costs between The Colour Cartel and the Buyer for any items to be returned to The Colour Cartel for a warranty claim.
Cancelling an Order
Once an order has been received, The Colour Cartel's normal returns policy will apply should a customer wish to cancel or amend the order.
Freight Methods
The Colour Cartel will arrange delivery of all Products to the Customer using a delivery method/carrier as selected by The Colour Cartel. A Buyer must not arrange its own courier to collect the Products from The Colour Cartel unless agreed in writing. The Customer may choose to pick up their Order in Store if they bring a printed copy of the receipt.
Products Damaged in Transit
Claims for alleged damage to Products caused in transit from The Colour Cartel to the destination specified by the Buyer must be notified to The Colour Cartel within 24 hours of receipt of delivery and the consignment note must be marked as "Received Damaged".
The Buyer must contact The Colour Cartel by e-mail to hello@thecolourcartel.com.au and obtain return instructions. The Buyer must also supply a copy of the consignment note to The Colour Cartel. The Colour Cartel will contact the Buyer to arrange a suitable remedy.
Marketing Communications
By ordering from The Colour Cartel you grant us the right to add your contact details to our database. From time to time we may contact you about offers and new products. You can easily be removed by either unsubscribing via a link in our marketing e-mails, or contacting our Customer Service at hello@thecolourcartel.com.au and we will remove you from all marketing communications.
Product Warranties
All products are covered by specific manufacturer's warranty and their accompanying terms and conditions. Please refer to the manufacturer's website for their specific warranty conditions.
Amendment of Terms and Conditions
The Colour Cartel may revise these terms and conditions from time to time. Buyers should therefore periodically visit this page to familiarise themselves with any such revisions.
